Welcome to PES School of Nursing Education (“PES,” “School,” “Institution,” “we,” “our,” or “us”). By accessing our website, submitting an inquiry, applying for admission, enrolling in a program, attending classes, making payments, or utilizing any services provided by PES School of Nursing Education, you acknowledge and agree to the following Terms and Conditions.


1. Institutional Discretion and Right to Refuse or Discontinue Enrollment

PES School of Nursing Education reserves the right, at its sole discretion and in accordance with applicable law, to deny admission, refuse enrollment, discontinue enrollment, remove a student from a program, cancel participation, or decline future services for reasons including, but not limited to:

  • Failure to meet admissions requirements
  • Submission of inaccurate, incomplete, misleading, or false information
  • Failure to comply with institutional policies or procedures
  • Professionalism, behavioral, or conduct concerns
  • Safety concerns
  • Nonpayment or delinquent accounts
  • Failure to meet attendance or academic requirements
  • Operational or staffing considerations
  • Regulatory or accreditation requirements
  • Clinical placement limitations
  • Any other legitimate institutional or operational reason deemed necessary by PES

Nothing contained within these Terms shall be interpreted as creating a guaranteed right to admission, continued enrollment, course availability, graduation, licensure, certification, employment, or program completion.


2. Course Availability and Class Cancellations

PES School of Nursing Education reserves the right to cancel, postpone, reschedule, combine, relocate, delay, modify, or discontinue any course, cohort, clinical rotation, laboratory experience, instructor assignment, or educational offering at any time due to:

  • Low or insufficient enrollment
  • Instructor availability or staffing changes
  • Clinical site availability
  • Regulatory requirements
  • Facility limitations
  • Weather emergencies
  • Public health concerns
  • Operational needs
  • Force majeure events
  • Other institutional considerations

PES will make reasonable efforts to offer affected students placement into another available course section or future cohort when feasible.

If PES cancels a course and no alternative placement is available, the institution may issue a refund of eligible tuition or institutional fees paid specifically for the canceled course. Refund eligibility shall be determined solely by PES.

Refunds, when issued, shall constitute the student’s sole and exclusive remedy related to course cancellation.


3. No Liability for Personal or Consequential Expenses

Students acknowledge and agree that PES School of Nursing Education shall not be responsible or liable for any indirect, incidental, consequential, personal, or third-party expenses incurred related to enrollment, anticipated attendance, or participation in any program or course.

This includes, but is not limited to:

  • Airfare or travel expenses
  • Hotel accommodations
  • Housing or dormitory costs
  • Transportation expenses
  • Vehicle expenses
  • Fuel costs
  • Rideshare or taxi costs
  • Childcare expenses
  • Lost wages
  • Relocation costs
  • Visa or immigration-related expenses
  • Meal expenses
  • Technology or equipment purchases
  • Clinical uniform expenses
  • Licensing or testing expenses
  • Third-party contractual obligations
  • Flight changes or cancellation fees

Students assume all risks associated with independent travel, relocation, scheduling, and personal financial arrangements made in anticipation of enrollment or attendance.


4. Admissions Information and Documentation

Applicants are responsible for ensuring that all information submitted to PES School of Nursing Education is truthful, accurate, complete, and current.

Submission of false, misleading, altered, fraudulent, or materially inaccurate information may result in:

  • Denial of admission
  • Withdrawal of acceptance
  • Immediate dismissal
  • Cancellation of enrollment
  • Forfeiture of tuition or fees where permitted
  • Reporting to applicable regulatory or licensing bodies when required

PES reserves the right to verify admissions information, employment history, certifications, identification documents, educational records, and background information at any time.


5. Tuition, Payments, and Refund Policies

All tuition, fees, deposits, and payment obligations are governed by the applicable enrollment agreement, payment plan agreement, institutional catalog, and refund policies in effect at the time of enrollment.

Unless otherwise required by law or expressly stated in writing by PES:

  • Payments are non-refundable
  • Deposits and seat reservation fees are non-refundable
  • Missed classes, voluntary withdrawal, dismissal, or failure to complete a program do not entitle a student to refunds
  • Chargebacks or payment disputes submitted in bad faith may result in collections activity, administrative withdrawal, denial of future enrollment, or legal action

Students are responsible for maintaining current payment information and timely payment arrangements.


6. Clinical Placements and Scheduling

Clinical placements, laboratory experiences, simulation activities, schedules, and instructor assignments are determined solely by PES School of Nursing Education and may be changed at any time.

PES does not guarantee:

  • Specific clinical sites
  • Specific instructors
  • Specific schedules or shifts
  • Preferred locations
  • Transportation arrangements
  • Employment opportunities

Students are responsible for arranging their own transportation and scheduling accommodations.


7. Website and Marketing Materials

All website content, marketing materials, social media content, brochures, catalogs, and advertisements are for general informational purposes only and may be modified, updated, or withdrawn at any time without notice.

Nothing contained in promotional materials shall be interpreted as:

  • A contractual guarantee
  • A promise of enrollment
  • A guarantee of program availability
  • A guarantee of licensure eligibility
  • A guarantee of employment
  • A guarantee that a specific cohort or class will run

8. Limitation of Liability

To the fullest extent permitted by law, PES School of Nursing Education’s total liability arising from or related to enrollment, attendance, services, educational offerings, or institutional operations shall be strictly limited to the amount of tuition actually paid directly to PES for the applicable course or program.

Under no circumstances shall PES be liable for indirect, special, incidental, punitive, or consequential damages.


9. Governing Law

These Terms and Conditions shall be governed by and interpreted under the laws of the State of Michigan.

Any dispute arising out of or relating to these Terms, enrollment, attendance, or institutional operations shall be brought exclusively within the appropriate courts located in the State of Michigan unless otherwise required by law.


10. Policy Modifications

PES School of Nursing Education reserves the right to modify, revise, update, or amend institutional policies, procedures, tuition, schedules, program offerings, and these Terms and Conditions at any time without prior notice.

Updated versions shall become effective upon posting to the institutional website or publication within institutional materials.
